केंद्र सरकार द्वारा हाल ही में गाड़ियों के आगे सेफ्टी गार्ड लगाए जानेपर प्रतिबन्ध को लेकर इंडियन सेफ्टी गार्ड इंडस्ट्रीज एसोसिएशन नेकड़ा एतराज जताते हुए इसे औचित्यहीन, कानून के विपरीत औरजल्दबाज़ी में उठाया गया कदम बताते हुए सरकार से इस आदेश कोवापिस लेने की मांग की है ! व्यापारियों के शीर्ष संगठन कॉन्फ़ेडरेशनऑफ़ आल इंडिया ट्रेडर्स (कैट) ने इस मांग का समर्थन करते हुएकेंद्रीय सड़क परिवहन मंत्री श्री नितिन गडकरी से इस मामले में सीधेहस्तक्षेप का आग्रह किया है !

 

केंद्र सरकार के सड़क परिवहन एवं राजमार्ग मंत्रालय ने हाल ही मेंमोटर वव्हिकल एक्ट, 1988 की धारा 52 के अंतर्गत सेफ्टी गार्ड कोअसुरक्षित कहते हुए इसे गाड़ियों पर लगाने पर प्रतिबन्ध लगाया हैऔर इस बारे में सभी राज्यों एवं केंद्र शासित प्रदेशों को पत्र भेजकरइस सलाह को लागू करने का आग्रह किया है ! धारा 52 में गाडी केपंजीकरण सर्टिफिकेट में वर्णित विवरण में किसी भी संशोधन करने परप्रतिबन्ध है जबकि सेफ्टी गार्ड पंजीकरण सर्टिफिकेट के दायरे में आतेही नहीं है !

 

इंडियन सेफ्टी गार्ड्स इंडस्ट्रीज एसोसिएशन के अध्यक्ष श्री नरेंद्र मदानने आज एक संवाददता सम्मेलन में कहा की सेफ्टी गार्ड को असुरक्षितकहना बेहद हास्यास्पद है जबकि वास्तव में सेफ्टी गार्ड गाड़ियों एवंउनमें बैठे लोगों की किसी भी एक्सीडेंट के समय बृहद रूप में रक्षाकवच का काम करते हैं !सरकार द्वारा जारी आदेश पत्र कानून सम्मतभी नहीं हैं क्योंकि सेफ्टी गार्ड को लेकर अभी तक कोई कानून, नियमअथवा उपनियम नहीं है ! यह सीधे तौर पर व्यापारियों के किसी भीतरह के व्यापार करने के संवैधानिक अधिकार के विरुद्ध है !

 

श्री मदान ने सरकार से इस आदेश को वापिस लेने की मांग करते हुएकहा है की यदि इस मुद्दे पर सरकार की कोई चिंता है तो वो बातचीतके माध्यम से दूर की जा सकती है और यदि जरूरी हो तो सेफ्टी गार्डके लिए कोई भी अतिरिक्त नियम भी बनाये जा सकते है !

 

संगठन का कहना है की सेफ्टी गार्ड्स को न तो मोटर व्हीकल एक्ट, 1988 अथवा सेंट्रल मोटर व्हीकल नियम , 1989 में किसी भी रूप मेंपरिभाषित नहीं किया है वहीँ धारा 52 जिसके अंतर्गत सरकार नेप्रतिबन्ध लगाया है का सेफ्टी गार्ड्स से कोई सम्बन्ध ही नहीं है ! सेफ्टीगार्ड्स एक प्रकार से एक सुरक्षा उपकरण है जो गाड़ियों में उनकी शेपके अनुसार लगाए जाते है और किसी भी एक्सीडेंट की सूरत में गाडीएवं गाडी में बैठे हुए लोगो को सुरक्षा प्रदान करते हैं ! सेफ्टी गार्ड्सअनेक प्रकार के सुरक्षित रॉ मटेरियल जैसे एबीएस, फाइबर, पोलीयुराथिन, स्टेनलेस स्टील, एल्युमीनियम अदि के द्वारा निर्मित होतेहैं जबकि गाडी निर्माताओं द्वारा प्लास्टिक का बम्पर लगाया जाता हैजो वास्तव में सुरक्षा के लिए खतरा है !

 

इस व्यापार में देश भर में प्रत्यक्ष एवं अप्रत्यक्ष रूप से 20 लाख लोगअपनी रोजी रोटी कमा रहे हैं जिनमें खास तौर पर निर्माता, रॉ मटेरियलसप्लायर.पैकर, फिटर, मैकेनिक, ट्रांसपोर्टर, आदि शामिल हैं ! यदि इसपर प्रतिबन्ध जारी रखा जाता है तो इन लोगों के सामने रोजगार काएक बड़ा संकट खड़ा हो जायेगा !

GOVT ORDER TO BAN BULL GUARDS

 

Industry body Indian Safety Guards Industries Association of India  (ISGIA) has expressed strong resentment over imposing ban on installation of Bull Bars  and Crash Guards on vehicles citing it as unsafe by Ministry of Road Transport & Highways of the Union Government under shelter of Section 52 of The Motor Vehicle Act,1988.The Ministry has issued an advisory to all States & Union Territories to implement the advise.

 

The ISGIA has termed the step as hasty, illogical, illegal and ultra-virus as Bull Bars or Crash Guards do not fall under the purview of Section 52 of the Act. Section 52 deals with modification in a Motor Vehicle to alter any details given in the Registration Certificate of the Motor Vehicle whereas the Registration Certificate does not contain any such detail which is modified by getting a Bull Bar fitted.Therefore Bull Bars are not in contradiction with Section 52.

The contention that Bull Bars or Crash Guards pose danger to human lives in case of road accidents is ill founded rather they construe best option for human and vehicle safety. While object issuance of said an advisory, the SGMAI said that the said advisory has not any legal sanctity as there is no Law, Rule or Bye-Law with respect to Bull Bars/Crash Guards.

 

Mr.Narender Madan, President,ISGIA has demanded the Government to withdraw the advisory of banning Bull Bar/Crash Guard and if at all Government has any concern, the same can be meted out by prescribing any additional norms. Such an action of the Government is infringement of fundamental right to practice and profession or to carry on any trade or business.​ The Confederation of All India Traders (CAIT) apex body of trading community has extended its support to the demand and called upon Shri Nitin Gadkari for his immediate direct intervention in the matter.​

 

The ISGIA said that Crash Guards/ Bull Bars have not been defined either in Motor Vehicle Act, 1988 or Central Motor Vehicles Rules, 1989. There is no legal provision pertaining to Crash Guards/ Bull Bars. Section 52 referred by Ministry in its letter has no relevance with the fitment of Bull Bars.

 

Crash Guards or Bull Bars is an guarding accessory or a preventive shield fitted in front of the Vehicle exactly according to shape of the vehicle which protects not only the Vehicle but even the occupants also in case of any road accident. It is noteworthy to mention that Bull Bars or Crash Guards are being manufactured in various materials like ABS, Fibre, Polyurethane, Alluminium, Stainless Steel etc. which are far safe and better than plastic bumpers fitted by Car Manufacturers and are highly pedestrian friendly as well as these guards are capable to minimise the impact of injury.

 

More than 20 lakhs people are employed in this trade across the Country including Manufacturers, Raw Material Suppliers, Packers, Fitters, Mechanics, Transporters, Porters and others. The action of the Government will fall as an axe over the livelihood of such large number of people as the consequence of the advisory is to close down the Industries.
